Terms of Service

1. Agreement to terms

By accessing or using JourneyStack (the “Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

JourneyStack is operated by Portis Cloud Services, a sole proprietorship registered in Ontario, Canada (“we”, “us”, or “our”).

2. Description of service

JourneyStack is a software-as-a-service (SaaS) platform that helps tour operators automatically request reviews from customers following trips and tours. Features include trip management, customer list management, automated review request emails, and review tracking.

3. Account registration

To use the Service you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately of any unauthorized use at abizerjafferjee@gmail.com.

You must be at least 18 years old and legally authorized to enter into contracts to use the Service.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Send unsolicited emails (spam) to individuals who have not given consent to receive communications from you
  • Upload false, misleading, or fraudulent customer data
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, copy, or create derivative works of the Service
  • Use the Service to harm, defame, or harass any person

You are responsible for ensuring that any customer data you upload has been collected with appropriate consent in accordance with applicable privacy laws (including Canada’s CASL for commercial electronic messages).

5. Your data

You retain ownership of any data you upload to the Service (trip data, customer lists, etc.). By uploading data, you grant us a limited licence to process it solely to provide the Service to you.

We take reasonable measures to protect your data but cannot guarantee absolute security. Please refer to our Privacy Policy for details on how we handle personal information.

6. Intellectual property

All content, design, code, and materials comprising JourneyStack are owned by Portis Cloud Services or its licensors and are protected by applicable intellectual property laws. You may not use our name, logo, or branding without our prior written consent.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any particular result (such as a specific number of reviews) will be achieved.

8. Limitation of liability

To the maximum extent permitted by law, Portis Cloud Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amounts you have paid to us in the three months prior to the claim, or (b) CAD $100.

9. Termination

You may stop using the Service at any time by closing your account. We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or for any other reason, with or without notice.

Upon termination, your right to access the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.

11. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
